The A66 Northern Trans-Pennine project has today reached a significant milestone in the project development as the Court of Appeal dismisses a request to appeal the decision of the High Court on the legal challenge brought about by Transport Action Network (TAN).
The legal challenge by Transport Action Network received its original court judgment in October 2024 when Mr Justice Mould said the case "does not raise an arguable basis" to claim the secretary of state was wrong to grant the order.
Transport Action Network lodged an appeal in December to the Court of Appeal’s to try and overturn the High Court ruling issued in October leading to today’s Court of Appeal’s decision.
The dismissal of the appeal means National Highways can continue to develop the A66 upgrade scheme, to bring about critical improvements to the route.
National Highways said “We’re pleased that the Court of Appeal, has dismissed the request to appeal the decision made in November by the High Court. “
“This project will improve safety, reduce congestion and connectivity”
“Utility diversions, archaeological excavations, and surveys are currently underway; whilst work continues to develop the main part of the scheme, including the detailed designs.”
The project remains part of the government’s ongoing spending review that an outcome is expected later in the year.
