Council Approves Change to Hours After Breach of Conditions

Westmorland and Furness Eden area planning committee at a meeting held at Penrith Town Hall today, considered an application by Booths for Variation of conditions of operating hours and delivery vehicle with reversing alarms to allow for deliveries from 09:30 and store/cafe opening from 09:30 on Sundays.


The application was submitted by E.H. Booth & Co Ltd following an investigation by Planning Enforcement Officers into a breach of the conditions whereby deliveries had commenced prior to the times as set out in the planning approval terms for the Penrith store.


The applicant acknowledged the situation and sought to regularise the delivery hours through the application to the council. 


The applicant E.H. Booth & Co Ltd had originally sought a change to the conditions to allow deliveries from 08:30 on a Sunday but this has since been revised to 09:30am.


Penrith Town Council had objected to the application saying it objected “as the original condition was imposed to protect residential amenity which is still important.”


In response to the change to 09:30 Sunday deliveries the town council maintained its objection as town council considered that “the adverse impacts on the nearby residential amenity, created through noise disturbance would significantly and demonstrably outweigh the benefits.” 


The town council added “Granting such an application would set a precedent for the other supermarkets within town who all currently have a condition limiting the operating and delivery hours.”


Despite the objections from the town council and a nearby resident to Westmorland and Furness Council Eden area planning committee approved the application with all six councillors voting unanimously in favour of the application approval.
