A question by a member of the public about the loss of Community Asset status for Coronation Gardens earlier this month was raised at this evening’s meeting of Penrith Town Council.
The question followed the removal of Coronation Gardens from the Community Asset Register by Westmorland and Furness Council earlier this month after the expiry of the five-year registration period. No application had been made to renew the registration before it expired by the town council.
Council chair and Town Mayor Cllr Bowen said that questions are normally required to be relevant to the meeting agenda, but confirmed that the question would be answered because it was a matter of public interest.
The submitted question asked how the Community Asset registration for Coronation Gardens had been allowed to lapse and when the Town Council would be resubmitting documentation to remedy this, also asking whether an extension would be submitted for the Town Hall Community Asset registration, which is also due to expire.
In response although not directly answering the question by the member of the public Cllr Bowen said the member of the public had been misinformed and stated that Coronation Gardens was not at risk.
She said that, based on information previously provided by Westmorland and Furness Council, when a Community Asset registration expires the asset is removed from the register and the associated restrictions are lifted, including those recorded with the Land Registry.
Cllr Bowen then said the Town Council would be considering the nomination of assets for re-registration at a future meeting of the town councils finance committee.
However despite the claims made by the town council chair in response to the public question, Westmorland and Furness Council has confirmed that Coronation Gardens was removed from the Community Asset Register following the lapse of the registration on 19 January 2026.
As a result, Coronation Gardens is no longer registered as a Community Asset.
The Land Registry records for Coronation Gardens have also been updated, removing the restrictions relating to Community Asset status.
