Planning appeal launched by firm over refused retrospective planning application.

A retrospective planning application refused by Eden Council in February for a large industrial scale sign located on the junction of Mardale Road and Hawswater Road at the Jeld Wen site on the Penrith industrial estate has seen the firm lodge an appeal.


The sign was installed in April 2022 displaying the company name along with days since last loss time accident, and directional signage for delivery vehicle access to the site.


However following complaints from residents in Castletown Eden Council as the local planning authority at the time opened an enforcement case requiring a retrospective application to be submitted by the firm for the sign.


The retrospective planning application was submitted in May 2022 however with the delays in the former eden council planning department the decision was not issued by the councils planning department until February 2023.


In the application the representative submitting the applications stated they "was not aware planning permission was required."


The retrospective application was refused by the council who said "The advertisement by virtue of its appearance, scale, massing and location results in an incongruous form of advertising which is sited within a highly visible location resulting in a prominent feature within the streetscene, therefore causing detrimental harm to the visual amenity of the area, contrary to the requirements of policies DEV5 and EC5 of the Eden Local Plan, the national planning policy framework and the national planning policy guidance."


The firm has now submitted a planning appeal against the councils planning officers refusal of the signs retrospective planning application.
